Mining sector: the review of the law on gold marketing is underway

The Ministry of Energy, Mines and Quarries has begun the process of reviewing the law on the organisation of the commercialisation of gold and other precious substances in Burkina Faso. On 31 March 2023, a national workshop to validate the draft law on the organisation of the marketing of gold and other precious substances in Burkina Faso was organised by the National Gold Anti-Fraud Brigade (BNAF).

The workshop was attended by many structures including civil society organisations, namely the mining craftsmen’s umbrella organisations, the Counter chambers, the Association of Women in the Mining Sector of Burkina Faso (AFEMIB) and the Burkinabe Council of Mines, Geology and Quarries (CBMGC). In his opening speech, the Secretary General of the Ministry, Jean Baptiste Kaboré, specified that within the framework of the supervision and control of the production and marketing circuit of gold and other precious substances in Burkina Faso, the government has adopted in 2 decades, 3 laws on the repression of fraud in the marketing of gold and other precious substances. The objective is to have an effective legal and institutional framework for regulating and controlling the production and marketing of gold and other precious substances. This is how the BNAF was created in 2006. It was time to review the law N°028 on the organisation of the marketing of gold and other precious substances to adapt it to the government’s will to bring adequate reforms in order to make the most of the immense opportunities offered by the mining sector. Jean Baptiste Kaboré reassured that the approach adopted by the Ministry for this review was participatory. Also, the present draft text is the result of a long consultation that required many meetings. He therefore invited the participants to learn from the application of the previous texts, to ensure that the weaknesses of the said texts have been corrected in this preliminary draft.  The validated text will be adopted by the government before being transmitted to the Legislative Assembly of the Transition.

After its adoption, regulations will be issued to clarify the operation of many parts of the law.
