The Perkoa mine operated by Nantou Mining Burkina Faso SA experienced flooding on 16 April 2022. The company subsequently announced the closure of the mine on 23 September 2022. The closure led to the dismissal of the employees. The former workers took Nantou Mining Burkina Faso SA to court. On Thursday 19 October 2023, the court found Nantou Mining Burkina Faso SA guilty of unfair dismissal and ordered it to pay damages to all the workers. Not satisfied with the verdict, the former workers have appealed.
The court ruled that the dismissal was unfair. In the judgement handed down in the legal action brought by the former workers, Nantou Mining Burkina Faso SA was ordered to pay the 266 plaintiffs 4 months’ wages and the sum of 3 million FCFA in damages to all the workers. At the same time, it dismissed the workers’ remaining claims and the defendant’s claims as unfounded.
The deliberation appoints Maître Coulidiaty Madeleine, bailiff in Ouagadougou, to enforce this judgement.
As a reminder, the Perkoa mine in Boulkiemdé (central-western region) was the only zinc mine in operation in Burkina Faso before its closure was announced following a flood that claimed the lives of 8 employees.
